TO THE FULLEST EXTENT PERMISSIBLE BY LAW , THE TOTAL AGGREGATE LIABILITY OF PHILLY TREND FOR ALL DAMAGES ARISING FROM THESE TERMS OR THE USE OR INABILITY TO USE THE SITE, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, WILL NOT EXCEED THE GREATER OF $100 OR THE TOTAL AMOUNT OF FEES PAID BY YOU TO PHILLY TREND IN THE SIX (6) MONTH PERIOD PRIOR TO THE DATE THE CLAIM AROSE.

9. Indemnification

You agree to indemnify and hold harmless Philly Trend and its affiliates from any claims, liabilities, damages, or expenses (including legal fees) arising out of your use of the Site or violation of these Terms.

You hereby irrevocably and unconditionally consent to waive any objection to the venue of any such litigation in such courts, and you expressly agree not to plead or claim in any Pennsylvania court that such litigation brought therein has been brought in an inconvenient forum.
